Austin Police Refuse to Enforce Texas Towing, Storage & Booting Law per Office of the Police Monitor

Today, in a meeting with the Austin PD Office of the Police Monitor, featuring Margo Frasier, ex Travis County Sheriff regarding the chain of command in the wrecker unit instructing the wrecker detectives not to enforce the State Towing Law verbatim, I see no reason for the Austin City Council to fund the wrecker unit FTEs. Tow Company owners now have problems just getting their tow truck operator’s APD Wrecker License renewed, waiting upwards two months and with the Auto Return contract in place, which Southside Wrecker is the only tow company towing from the downtown area, the public and small businesses (legit tow companies) are screwed.

According to Margo Frasier, APD is not going to file criminal charges against the dishonest companies, like J&J, Reliant, Park Right, Customz, G&G, Tow Times, Austin Express, Eagle One, Aviles, A&A, Central, Clark Auto Care, Lamont & Sons, Albert’s and Pronto, for towing vehicles in violation of State Law.

Therefore, the public is going to have handle these issues of illegal towing based on property managers accepting kickbacks (2308.401), illegal tow signs posted in the wrong locations (2308.301 & 302), tow truck drivers burglarizing vehicles to remove permits/steal personal property, move legally parked vehicles into violations, most of which are prohibited at apartment complexes (2308.253) and refusing to accept responsibility for damaging vehicles they outright steal, as you will receive zero assistance of our Police Department in these matters.

Reliant and J &J Towing lead the pack of thieves in stealing vehicles because their tow signs are not legal and both companies pay property managers kickbacks in the form of cash, gift cards, free towing for their employees and free legal representation in Court when sued. Since both these companies enjoy targeting low-income apartment complexes, I would not expect those residents not to take a stand and confront their tow truck drivers rather the vehicle they attempting to tow is theirs, if a driver gets assaulted, so be it as they damn sure deserve it. Again, these issues of residents and their guest having to use whatever means possible to protect their vehicles from being stolen, is because the Police refuse to enforce the law that has been in effect since 1993.

Turning apartment complexes into permit parking only and forcing their guests and family members to park on the street in high crime areas is just asking for violence to happen. I drove a tow truck for 25 years and the companies I managed, we were never as ruthless as the predatory tow companies we have operating in Central Texas today, as they simple don’t care what someone thinks, as the tv stations never do the correct type of story, as in the predatory tow industry, any news story is free advertising as dishonest businesses will calling them, knowing they can benefit financially from hiring these criminal enterprises disguised as tow companies.

Nobody enjoys waking up and walking outside to go to work, school or a doctor’s appointment, only to find their vehicles missing, from their own assigned parking space where they live, only to be told by the Police after reporting it stolen, your vehicle has been towed away. Scratching your head wondering why your vehicle towed, only to be told by a turd on the phone at the tow company, your vehicle was unauthorized to be parked on the property, although the vehicle is listed on your apartment lease. To make matters worse, the tow yard is some 15 to 45 miles from your complex, no possible way to get to work or school on time, as nobody will take you, so you go straight to the apartment office to ask why your vehicle was towed, only to be showed a photo of the vehicle’s tire 2″ over the parking space stripe and your cunt managers says their nothing she can do although she gave them authorization to tow your vehicle.

Fight for your rights you are guaranteed by State Law after your vehicle towed, take the property management company and the landowner to Court, specifically, Travis County JP Susan Steeg, towed from anywhere in Travis County or Williamson County JP Edna Staudt towed anywhere in Williamson County, as these two Judges¬† rule based on the law as it is written when filing the Small Claims Lawsuit for Statutory Violations and leaving the tow company out of the lawsuit. If you don’t have the money for the filing fees, both Justice Courts have a waiver based income that waives the $200 in filing and service fees. The decision on encounters with the tow truck operators is a personal choice a vehicle owner or operator makes, rather a violent assault or outright shooting the driver, comes with consequences, as most tow trucks have cameras mounted on them, so should you choose to get in someone’s face, be prepared, as many predatory tow truck drivers are convicted felons and armed, as they are just as scared as the person they are suddenly approached by. If your vehicle is towed to a vehicle storage facility, always record all contact, even the call to the storage facility and under no circumstance sign any of the storage facility’s business paperwork, unless you want to become a victim of identity theft. It’s highly advised everyone following the Storage Facility Procedures as prescribed by this website as everything in red is violations of State Law you will collect the civil penalty for.¬† A vehicle storage facility is regulated by the Texas Department of Licensing & Regulations and the storage facility is required by State law to give you no less than three documents, the storage facility release form, a copy of the nonconsent tow fee schedule of the tow company that delivered your vehicle to the storage facility, a copy of the tow ticket and a copy of the inventory completed by the storage facility, which allows the $20 Impound Fee. If they refuse to provide you these documents, call the Police or Sheriff prior to leaving and make sure you record the entire episode since most of these storage lot employees are pathological liars as some storage lot employees under the influences of narcotics.

I know this State Law reference private property towing better than anyone else, since I wrote the original draft in 1991 and 1993 reference the Rights of A Stored Vehicle Owner, as the core elements have remained intact for the past 25 years, When the law were passed by the Legislature and signed into law by the Governor when, is was codified in the Vernon Civil Statutes, then re-codified again into the Transportation Code and re-codified in the Occupations Code, where it is today.
